Description

At Morgan & Morgan, the work we do matters. For millions of Americans, we’re their last line of defense against insurance companies, large corporations or defective goods. From attorneys in all 50 states, to client support staff, creative marketing to operations teams, every member of our firm has a key role to play in the winning fight for consumer rights. Our over 6,000 employees are all united by one mission: For the People.

Morgan & Morgan Is Seeking an ERISA Class Action Attorney

We are looking for an experienced ERISA class action attorney to drive the firm's emerging ERISA class action practice.

Why This Role Is Different

If you've spent your career litigating ERISA class actions, you already have the judgment and instincts most firms spend years trying to develop. What you may not have is the freedom to use them on your own terms. We're looking for an experienced attorney ready to take real ownership: to shape strategy, set the direction of the cases you litigate, and help build a practice group rather than simply staff one. You'll bring your expertise to a firm with the resources, reputation, and national reach to go after the most complex ERISA matters in the country — with the autonomy to run them your way.

What You Will Do

  • Build and litigate ERISA class actions from the theory stage through trial
  • Collaborate with a talented team of employment and ERISA attorneys across the firm's national platform
  • Contribute to the strategic development of the ERISA Class Action practice

What We Are Looking For

  • JD from an ABA-accredited law school
  • Active bar membership in good standing in the state where you are based
  • Meaningful ERISA class action litigation experience — plaintiff or defense side — including extensive experience in breach of fiduciary duty cases involving retirement or health benefits
  • Strong litigation fundamentals: motion practice, discovery, and courtroom experience
  • A collaborative, self-directed work style with the drive to build and grow within a high-performing team

Where We Are Growing

We are actively hiring across multiple markets, including Boston, Chicago, Los Angeles, Detroit, Washington DC, Philadelphia, and beyond.

An Invitation

If you've been representing plan sponsors and ever wondered what it would look like to switch sides — this is your invitation. If you've been representing plaintiffs and are looking for a platform with greater resources and reach, we want to hear from you. And if you're somewhere in between, still figuring out where your career should go next, we'd love to have that conversation.

At Morgan & Morgan, ERISA is not a niche add-on. It is a practice area the firm is committed to growing.

About this role

Morgan & Morgan is building out a dedicated ERISA class action practice and seeking an experienced attorney to lead that effort. This role offers genuine autonomy to shape strategy and case direction rather than simply execute someone else's vision. You'll work on complex breach of fiduciary duty cases involving retirement and health benefits, moving matters from initial theory through trial, while collaborating with employment and ERISA attorneys across the firm's national platform.

The ideal candidate has substantial ERISA class action litigation experience—either from the plaintiff or defense side—with strong fundamentals in motion practice, discovery, and courtroom work. If you've spent years on the defense side representing plan sponsors and are curious about plaintiff-side work, or if you're already a plaintiff's attorney seeking a larger platform with greater resources and reach, this is positioned as a genuine opportunity to grow a practice area the firm is committed to developing. The role is based in Atlanta and requires in-office work.

Morgan & Morgan offers medical and dental insurance, a 401(k) plan, paid time off, and paid holidays for full-time employees. The firm is one of the nation's largest plaintiff-side firms with over 6,000 employees and national reach across multiple markets.
